1. Introduction

Welcome to Klasu. These Terms and Conditions ("Terms") govern your access to and use of the Klasu platform, available at klasu.co.uk ("Platform"), operated by Klasu ("we", "us", "our").

By creating an account or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

We may update these Terms from time to time. We will notify registered users of material changes by email or via the Platform. Your continued use of the Platform after any changes constitutes acceptance of the updated Terms.

Klasu is an online marketplace that connects Students with Tutors for private tutoring sessions. We provide the technology platform that facilitates the discovery, booking, payment, and delivery of Lessons.

Klasu acts solely as an intermediary. We are not a tutoring provider, educational institution, or employer. Tutors are independent, self-employed individuals who use the Platform to offer their services. We do not employ, supervise, or direct Tutors, and we are not responsible for the quality, content, or outcome of any Lesson.

Where a Student is under the age of 18, a parent or legal guardian is responsible for their use of the Platform. This may involve the parent or guardian creating and managing the account directly, or linking a separate child account to their own for oversight.

4.3 Account Security

You are responsible for all activity that occurs under your account. You must notify us immediately at support@klasu.co.uk if you become aware of any unauthorised use of your account. We are not liable for any loss arising from unauthorised access to your account where you have failed to keep your login credentials secure.

5. Tutor Responsibilities

5.1 Self-Employment

Tutors who register on the Platform do so as self-employed individuals. It is the Tutor's responsibility to comply with all applicable tax obligations, including registering with HMRC and declaring earnings. Klasu does not withhold tax on behalf of Tutors and is not responsible for any Tutor's tax affairs.

5.2 Profile Accuracy

Tutors must ensure that all information in their profile is accurate, current, and not misleading. This includes qualifications, experience, subjects offered, and pricing. We reserve the right to remove or amend any profile content that we consider inaccurate or inappropriate.

5.3 Background Checks

Tutors may be required to provide a valid Disclosure and Barring Service (DBS) certificate or subscribe to the DBS Update Service. Where a Tutor provides DBS information, Klasu may verify this through the DBS Update Service. However, Klasu does not guarantee the accuracy or completeness of any background check and does not accept liability for the conduct of any Tutor.

5.4 Stripe Connect

To receive payments, Tutors must complete onboarding with our payment processor, Stripe, via Stripe Connect. Tutors agree to comply with Stripe's terms of service in addition to these Terms.

5.5 Professional Conduct

Tutors must conduct themselves professionally at all times when using the Platform. This includes delivering Lessons as agreed, communicating respectfully with Students, and complying with the content and messaging rules set out in Section 12.

6. Student Responsibilities

6.1 Age Requirements

Students must be at least 18 years of age to create an account and book Lessons for themselves. Students under the age of 18 must be represented by a parent or legal guardian who creates a parent account, gives consent for the student to receive tuition, and accepts these Terms on their behalf.

6.2 Parental Supervision

Any parent or guardian who arranges Lessons for a child under the age of 18 should take appropriate steps to ensure the child's safety during Lessons. Klasu is not responsible for any dispute between a person under 18 and their parent or guardian, nor for supervising Lessons.

6.3 Payment Obligations

Students (or their parent/guardian) are responsible for making timely payments for Bookings. Unpaid Bookings may be automatically cancelled in accordance with our payment policies. All payments are processed securely through Stripe.

6.4 Conduct

Students must behave respectfully towards Tutors and other Users. Abusive, threatening, or inappropriate behaviour may result in account suspension or termination.

7. Bookings and Scheduling

7.1 Making a Booking

Bookings are made through the Platform by selecting a Tutor, choosing an available time slot, and completing payment. A Booking is confirmed once payment has been authorised or received.

7.2 Lesson Delivery

All Lessons are delivered online through the Platform's Online Classroom. Both the Tutor and Student will receive access links prior to the scheduled Lesson time.

7.3 Rescheduling

Users may request to reschedule a Booking through the Platform, subject to mutual agreement between the Tutor and Student. Rescheduling requests must be made within the cancellation window to avoid fees.

8. Cancellation Policy

8.1 Tutor-Set Cancellation Policy

Each Tutor sets their own cancellation notice period, displayed on their profile (the default is 24 hours before the scheduled Lesson). Students who cancel within the notice period may be charged a cancellation fee as set by the Tutor.

8.2 Tutor Cancellations

If a Tutor cancels a Booking, the Student will receive a full refund. Repeated cancellations by a Tutor may result in account review or suspension.

8.3 Unpaid Bookings

Bookings that remain unpaid may be automatically cancelled by the Platform. The specific timeframes for automatic cancellation are determined by the Platform's administrative settings.

9. Payments and Fees

9.1 Pricing

Tutors set their own hourly rates, which are displayed on their profiles. The total Lesson price shown to Students includes the Tutor's rate and any applicable Service Fee.

9.2 Service Fee

Klasu charges a Service Fee on each Booking. This fee is included in the price shown to Students at the time of booking and covers the costs of operating and maintaining the Platform.

9.3 Payment Processing

All payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms of service. Klasu does not store your full payment card details.

9.4 Tutor Payouts

Tutors receive their earnings (the Lesson price minus the Service Fee) via Stripe Connect. Payouts are subject to a holding period after the Lesson has been completed, as determined by the Platform's administrative settings. Tutors are responsible for ensuring their Stripe account details are correct and up to date.

9.5 Refunds

Refunds may be issued in the following circumstances:

Refunds are processed through Stripe and may take several business days to appear in the Student's account. Klasu reserves the right to limit the number of refunds a Tutor may issue within a given period.

9.6 Currency

All prices and payments on the Platform are in British Pounds Sterling (GBP).

10. Online Classroom

10.1 Lessonspace

Lessons are delivered through an integrated Online Classroom powered by Lessonspace. By participating in a Lesson, you agree to use the Online Classroom in accordance with these Terms and any additional terms provided by Lessonspace.

10.2 Technical Requirements

Users are responsible for ensuring they have a stable internet connection, a compatible web browser, and functioning audio and video equipment. Klasu is not liable for technical issues arising from a User's own equipment or internet connection.

10.3 Lesson Recordings

All Lessons conducted through the Online Classroom may be recorded. By using the Platform, you acknowledge and agree that your Lessons may be recorded and that such recordings may be stored and used by Klasu for safeguarding, quality assurance, and dispute resolution purposes.

Recordings are retained by Lessonspace for a period of 90 days, after which they are automatically and permanently deleted. Klasu does not retain separate copies of recordings beyond this period.

Recordings may be made available to the Student (or their parent or guardian) for review and learning purposes. Klasu may also access recordings for safeguarding, quality monitoring, and dispute resolution purposes. Tutors do not have access to Lesson recordings. Users must not distribute, publish, or share recordings with any third party without the express consent of all participants.
